Patient consent – Guidance for the practice

What you get

Two print-ready PDFs for your patients, each in German and English. The German version is binding.

  • Consent: print, have it signed, keep it in the patient's medical record.
  • Waiting-room notice: print and put up where patients can see it.

You don't need to add anything. The consent states the maximum period of 90 days for texts, so it is correct for any retention period you set in Nixi AI under Settings › Privacy („Einstellungen › Datenschutz“) (1–90 days, default: 30 days).

The documentation itself is based on Art. 9(2)(h) GDPR in conjunction with § 22(1) no. 1(b) BDSG (Federal Data Protection Act) and the medical documentation obligation (§ 630f BGB, German Civil Code). The consent covers recording the non-publicly spoken word (§ 201 StGB, German Criminal Code) and creates transparency.

A release from medical confidentiality for Nixi AI is not required: as a participating person under § 203(3) StGB, Nixi AI is bound to confidentiality through the “Data Processing Agreement (DPA)”. The consent therefore deliberately contains no such release.

In day-to-day practice

  • Before the first recording, obtain consent and keep the signed original in the patient's medical record.
  • Refusal and withdrawal: note them with the date in the medical record, and document without recording from then on.
  • Minors and persons under legal guardianship: if the patient cannot validly consent themselves, the legal representative signs.
  • Video and telephone consultations: obtain consent before the recording starts and note in the record when and in what form it was given.
  • Other people present, such as relatives, companions or interpreters, are recorded too. Inform them before recording, and do not record if anyone objects.

Your practice's privacy information

The consent only mentions patients' rights briefly. The full information under Art. 13 GDPR – including restriction of processing, data portability and the right to object – belongs in your practice's privacy information. Add the use of Nixi AI there.

Updates

Always use the current version, and replace printed forms and the notice as soon as the PDFs change.
